This Privacy Policy sets out the rules for processing the personal data of users of the website swiatkowski-adwokat.pl and of persons contacting the Law Office of Advocate Hubert Świątkowski, PhD. - responding to your enquiry – on the basis of consent (Article 6(1)(a) GDPR) and for the purposes of the Controller's legitimate interests (Article 6(1)(f) GDPR);
- providing legal assistance – on the basis of a contract or of steps taken with a view to entering into one (Article 6(1)(b) GDPR);
- compliance with legal obligations to which the Controller is subject, including those arising from the Act of 26 May 1982 – Law on the Bar (Prawo o adwokaturze) and from the Act on Counteracting Money Laundering (Article 6(1)(c) GDPR);
- pursuing claims or defending against them – on the basis of the Controller's legitimate interests (Article 6(1)(f) GDPR).
4. Legal professional privilege
All information provided to the firm in connection with the provision of legal assistance is covered by legal professional privilege (tajemnica adwokacka) within the meaning of Article 6 of the Act of 26 May 1982 – Law on the Bar. This duty of confidentiality is unlimited in time and absolutely protected.
5. Data retention period
Your personal data are stored:
- for as long as necessary to respond to your enquiry and to conduct correspondence;
- for the term of the agreement for the provision of legal assistance and for the period required by law (including the limitation period for claims and record-keeping obligations);
- for no less than the period required by tax and accounting regulations (5 years).
6. Recipients of data
Your personal data may be disclosed only to entities authorised under the law and to trusted entities with which the Controller cooperates in order to provide its services properly, in particular:
- IT and hosting service providers;
- the accounting office;
- courier and postal operators (for correspondence);
- public authorities, where required by applicable law.
7. Your rights
In connection with the processing of your personal data, you have the following rights:
- the right of access to your data and to obtain a copy of them;
- the right to rectification (correction) of your data;
- the right to erasure of your data (to the extent that this does not conflict with the Controller's legal obligations);
- the right to restriction of processing;
- the right to data portability;
- the right to object;
- the right to withdraw consent at any time (where processing is based on consent);
- the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) at ul. Stawki 2, 00-193 Warsaw, Poland.
